Terms and Conditions – All Star Heating and Cooling

These Terms and Conditions govern all services provided by All Star Heating and Cooling. By scheduling or receiving service from us, you agree to the following terms:

1. Payment Terms

Payment is due upon completion of services unless otherwise agreed in writing. For projects exceeding $15,000, a deposit of up to 50% may be required before work begins. Final payment is due immediately upon job completion and prior to release of any warranties, project documentation, or completion certificates.

2. Payment Schedule for Multi-Phase Projects

If a project is completed in phases, payment for each completed phase or itemized service is due immediately upon completion of that portion of work. Timely payment allows us to maintain operations and keep projects on schedule.

3. Accepted Payment Methods

We accept cash, check, debit card, credit card, and offer third-party financing options (subject to approval). A processing fee may apply to card transactions. Financing terms will be provided in writing prior to commencement of work.

4. Permit Fees

All required permit fees are the responsibility of the customer and are nonrefundable, regardless of project completion status.

5. Unforeseen Circumstances & Additional Work

During the course of work, we may discover concealed issues that require additional repairs, services from other contractors, or changes to the agreed scope of work. Any such changes will be documented and approved in writing, and may affect cost and timelines. Work completed up to the point of suspension must be paid in full before the technician leaves the job site.

6. Quote Validity

All written quotes are valid for 30 calendar days from the date issued. After this period, pricing and availability are subject to change.

7. Refund & Cancellation Policy

  • Cancellations made at least 48 hours prior to the scheduled start date will not incur a cancellation fee.
  • Cancellations made within 48 hours of the start date may incur charges for materials purchased, permits obtained, or labor invested.
  • Refunds (when applicable) will be reduced by nonrefundable material costs, completed labor, and permit fees.
  • Special-order items are nonrefundable once ordered.

8. Ownership of Materials & Equipment

All materials and equipment remain the property of All Star Heating & Cooling until payment is made in full.

9. Homeowner Presence & Prepayment Requirement

The homeowner must be present for all scheduled appointments unless prior written approval is given. If the homeowner will not be present, full payment is required before work begins.

10. Warranty & Liability

  • Workmanship Warranty: 30-day warranty on repairs and 1-year warranty on equipment replacement from the date of service or installation.
  • Warranty Conditions: Annual maintenance is required to maintain active labor and parts warranties. Failure to maintain the system may void coverage.
  • Exclusions: No warranty is provided on drain lines. We accept no liability for drain line blockages, failures, or resulting damage. We are not responsible for damage caused by misuse, neglect, third-party alterations, normal wear and tear, or conditions beyond our control (including Acts of God, extreme weather, fire, or flood).
  • Service Hours for Warranty Work: Warranty work is performed Mon–Fri, 8:00 AM–5:00 PM (excluding holidays). Emergency service outside normal hours will be billed at our emergency rate, regardless of warranty status.
  • Third-Party Interference: Any repairs, alterations, or modifications by others without our prior written consent will void warranties in full.

11. Disputes & Defect Resolution

All disputes regarding invoices must be submitted in writing within 7 days of the invoice date. For warranty claims, reasonable access must be provided during regular business hours for inspection and evaluation. Customers must allow us a reasonable opportunity to correct any issue before seeking outside assistance.

12. Professionalism & Safety

We conduct ourselves with professionalism, courtesy, and respect, and expect the same from clients and anyone on-site. We reserve the right to pause or terminate work if we encounter abusive, threatening, unsafe, or unsanitary conditions. In such cases, the customer will be invoiced for all work performed and materials purchased up to the point of termination.

13. Price Matching (If Offered)

If we offer price matching, the customer must provide a written, apples-to-apples bid from a licensed, insured, reputable local company. The bid must reflect identical scope, materials, and service standards. We reserve the right to verify competing bids before matching.

14. Referrals

Any referrals provided are for convenience only. These companies are not affiliated with All Star Heating & Cooling. Customers are responsible for verifying licenses, insurance, and reputation before hiring.

15. Jurisdiction

These terms are governed by the laws of the State of Florida. Any disputes will be resolved exclusively in the county where the work was performed.”
